RETURN AND REFUND POLICY

You (the Consumer) are entitled to return any “Clive Christian” brand products (the Products) purchased via the website www.clivechristian.com (the Website) in the following circumstances (i) if there is something wrong with the Product (e.g., the Product does not conform with the description of the Product in the sales contract), or (ii) to exercise the Consumer’s right to cancel the relevant sales contract.

Please refer to the general terms and conditions of online sale (the General Conditions), available at the following link https://www.clivechristian.com/pages/conditions-of-sale, for the full details of the terms & conditions that apply to the purchase of the Products.

Capitalized terms not otherwise defined herein shall have the same meaning ascribed to them in the General Conditions.

 

1. WARRANTY AND RETURN OF NON-CONFORMing PRODUCTS

For a period of 2 (two) years from the date on which the purchased Products have been delivered to you, the Products shall comply with the Product warranty agreed in the sales contract according to paragraph 8.1 of the General Conditions (the Warranty).

If the Products do not conform with the Warranty, you must let the Seller know that there is something wrong with the Product by submitting a return request (Return Request) to the Seller by e-mail to the address customercare@clivechristian.com. In particular, in the Return Request you must state the reasons for returning the Products, indicate the order number and attach one or more images of the Products that clearly show where/how the Product does not comply with the Warranty.

Once the Return Request is submitted, you will receive a confirmation e-mail containing the instructions on how to proceed for the return of the Products, including the return label. Such e-mail and the Seller’s authorization to return the Products shall not be interpreted as acceptance by the Seller of the alleged non-conformity of the Products or Seller’s liability under article 8 of the General Conditions.

The Products that the Seller has authorized to be returned shall be shipped to the Seller within 15 (fifteen) days from the receipt of the confirmation e-mail by the Seller and to the address of the Seller’s warehouse indicated in the Seller’s e-mail.

If the non-conformity of the returned Products is confirmed by the Seller, you will be entitled to have such Products repaired or replaced pursuant to paragraph 8.4 of the General Conditions, or, in the cases referred to under paragraph 8.5 of the General Conditions and pursuant to this paragraph, to either a proportionate reduction of the Products’ price, a full refund and/or the termination of the sales contract.

In case the Seller has to refund you part of or the entire price for the Products, the Seller will make the refund, where possible, using the same means of payment used to purchase the Products (credit card, prepaid card, PayPal, etc).

Please refer to article 8 of the General Conditions for further information on the Products’ warranty and remedies available for a lack of conformity of the purchased Products.

 

 2. RIGHT OF CANCELLATION AND RETURN OF PRODUCTS

 If for any reason you are not satisfied with the Products purchased, you are free to withdraw from and cancel your sales contract with the Seller within 14 days after (i) the day on which the Products have been delivered to you, or (ii) if the Products, ordered through one order, have been delivered separately, from the date after you have received the last Product.

If you would like to exercise your right of withdrawal/cancellation, you must send to the Seller, at the following e-mail address customercare@clivechristian.com between the hours of 9.00am – 5.00pm Monday to Friday, an explicit declaration of your intention to exercise the right of cancellation and you may use the model cancellation form provided at the end of this document to do so (but use of the model cancellation form is not mandatory) (the Cancellation Communication).

To meet the cancellation deadline, it is sufficient for you to send your Cancellation Communication before the cancellation period has expired.

You have to return the Products to the Seller within and no later than 14 days from the date on which you have sent the Cancellation Communication to the Seller and to the address of the Seller’s warehouse indicated by the Seller. Returns are at your own cost, unless the Seller offered free returns when you bought the Products.

In case of proper exercise of the right of withdrawal from the sales contract, other than in respect of international delivery costs and non-standard delivery costs, the Seller will refund you all payments made for the purchase of the Products, without undue delay and in any event no later than (i) 14 days after the day the Seller receives back from you any Products supplied, or (ii) (if earlier) 14 days after the day you provide evidence that you have returned the Products. Such refunds will be made, where possible, using the same means of payment used by you for the initial transaction. In case you request the refund via a different means of payment, you will be charged for any additional fees incurred by the Seller as a result of the choice of such means. The reimbursement will be made only to the extent that the returned Products are intact and not opened.

You will be held liable for any diminished value of the Products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the Products themselves. Therefore, if the returned Products are found to be damaged (for instance showing signs of wear, abrasion, nicks, scratches, deformation, etc.), not complete with all parts and accessories (including unaltered labels still attached to the Products), unaccompanied by the instructions/notes/manuals supplied, or not contained in their original packaging and packing, you will be liable for the decreased value of the Products, and be entitled to receive from the Seller a refund only equal to the residual value of the Products, if any.

In case of purchase of sealed Products, which are unsuited to be returned for hygienic or health protection reasons, the right of withdrawal is excluded if these Products have been opened after the delivery. Therefore, in relation to these Products, the withdrawal will be admitted, and, accordingly, the return accepted, only if the returned Products and their packaging are perfectly intact and unopened.

You may also not change your mind, and shall have no right to cancel the sales contract for an order if:

(a) a Product has been made to your specifications or is otherwise clearly personalized; or

(b) a Product (or Products) have become mixed inseparably with other items after delivery.
